Woman accused of killing bicyclist in Northland charged with DWI-related offense

PLATTE COUNTY, Mo. (KCTV) - The woman who allegedly hit and killed a bicyclist early Monday morning is in jail with a DWI-related charge, court documents show.

On Sept. 16, the Missouri State Highway Patrol reported the death of 25-year-old Xavier Anderson of Kansas City, Missouri.

Anderson was riding his bike on NW Tullison Road in Riverside, Missouri, around 5:30 a.m. when he was allegedly hit from behind by 25-year-old Emily Davis, who was driving a Chevrolet Cruze.

When officers responded to the scene, one reported seeing “A heavily damaged bicycle off the right side of the roadway near an electric pole. The pole itself had a gouge mark in it from the impact of the bicycle.”

Anderson had already been taken to North Kansas City Hospital where he was later declared dead by hospital staff at 8:51 a.m.

Officers with the Riverside Police Department and MSHP met Davis about half a mile down the road from the crash. There, several officers reported smelling “the faint odor of an alcoholic beverage” on Davis,” the probable cause statement detailed.

Davis reportedly itted to the officers that she had “consumed alcohol” and “had been at Argosy Casino for most of the night and into the morning.”

Documents state that Davis provided two blood-alcohol breath tests that morning. The first, sometime after 7:09 a.m., indicated that Davis had a blood alcohol concentration of 0.164 percent. A second test, performed at 8:15 a.m., indicated 0.139 percent BAC.

Missouri’s legal limit to drive is 0.08%.

Davis was taken to the Platte County Jail and charged with DWI- Death Of Another Not A enger. She is being held on a $50,000 cash-only bond.
