Woman files lawsuit against Sealy Mattress after fiancé dies inside company trailer
ATLANTA, Ga. (WANF/Gray News) - A woman in Atlanta filed a lawsuit against the world’s largest mattress manufacturer after her fiance died inside one of the company’s trailers.
Jasmine Jennings' suit accuses Tempur Sealy International and several d groups of negligence in the death of 27-year-old Joshua Armour.
On Oct. 22, Armour, who was suffering from a mental health crisis, went missing. The next morning, he called his brother and said he was in a dark, unfamiliar place, according to the lawsuit.
Through his phone’s location services, Armour’s family tracked him to a Sealy mattress facility. However, a representative allegedly refused to let them in and wouldn’t search the property, telling the family to call the police.
It’s unclear what role law enforcement played in searching for Armour.
On Oct. 23, Armour’s phone battery died and his family lost with him.
Security video showed an unknown person getting into the facility, so the company told its employees to lock the doors to all its mattress storage trailers — one of which Armour was in, the suit said.
He was found dead inside the trailer six days later during what the family’s attorneys call a routine check.
In a news conference, Attorney Kate Reddy said the tragedy could have been avoided.
“This is a case about how one corporation’s choices have led to an entirely preventable tragedy that has left Joshua’s family torn apart,” she said. “They had every opportunity to save Joshua’s life. It’s about their choice to ignore the pleas of their family.”
“When Sealy did act, we know they acted to lock trailers, in order to save their property, save their mattresses, look out for their own bottom line,” Attorney Mark Johnson added.
Jennings and Armour, who were together for six years, have two young children.
“He was so genuine, so full of love, such a great father,” Jennings said. “He didn’t come from the best background, but he was trying so hard to be the best person he could be, and to have his life ended so shortly...”
She said she wants justice and for no other family to experience what they are going through.
“I myself don’t understand how this could happen. How such carelessness could be taken in this situation. I just want answers so I can get justice for Joshua’s family and so this can never happen again,” Jennings said, wiping away tears.
In a statement, Tempur Sealy International said it was “saddened by this tragic incident.”
“Our deepest sympathies are with the victim’s family and loved ones. We have been conducting a thorough investigation to understand all the facts and circumstances surrounding this incident and have fully cooperated with local authorities,” the statement read. “As this is an ongoing investigation, we are unable to provide further details or comment at this time.”
