Arrest warrant issued for New Mexico man accused of Missouri child sex crime
CLAY COUNTY, Mo. (KCTV) - A warrant has been issued for the arrest of a disabled veteran in New Mexico accused of a felony child sex crime in Missouri.
Clay County, Missouri, Circuit Court records filed on Friday, May 23, indicate that Maximillian K. Ulibarri, 56, of Rio Rancho, New Mexico, has been charged with statutory sodomy.
A probable cause statement filed by the Clay County Sheriff’s Office revealed that on Jan. 30, law enforcement officials received a report of a possible child sex crime. The child’s mother reported that Ulibarri, a disabled veteran, had recently moved into the home.
When her daughter began to act uncharacteristically, the mother reported that she learned Ulibarria had made the 7-year-old touch his genitalia. An interview with the victim in February found that Ulibarri had threatened to lie to the child’s mother and get her in trouble if she did not comply.
Investigators said the child also told them that Ulibarri attempted to pull her pants down on several occasions. She was able to stop him each time. They also learned that Ulibarri had been in the process of moving to Albuquerque, New Mexico, at the time.
The Rio Rancho Police Department said Ulibarri denied the incident to investigators. He continued to state that his disability does not affect his physical actions and that he was in control the whole time.
As a result, state statutes dictate that Ulibarri could be sentenced to life in prison if convicted. A warrant was issued for his arrest on Friday with the condition of a $50,000 bond.
As of Tuesday afternoon, Ulibarri does not appear to have been taken into custody. A hearing has not yet been scheduled in the case. No further information has been released.
